Additional Privacy Terms – Bug Capture

Data Import
By accessing and using the Bug Capture Tool (formerly known as “Bird Eats Bug”) available at https://www.birdeatsbug.com, you acknowledge and consent to the transfer of Data including Account Related Information from BrowserStack to be used to create an account and be processed to provide you with Services. BrowserStack will take all necessary measures to ensure the security of your Data during transfer and processing. The Bug Capture platform will use your imported Data solely for the purpose of providing the Services and will not share your Data with any third parties without your consent.

Service Integrations
While using Bug Capture you may voluntarily use extensions to integrate third party services or products with the Services. Accordingly, you authorize BrowserStack to communicate with and operate the third party’s integrated service. Transmitting Data may be subject to limitations, errors or disruptions caused by the use of such third party services or products.

BrowserStack will not be responsible for any disruptions or errors or incomplete Data import resulting from such limitations. When you use a third-party resource for Data import, you will be subject to its terms and conditions and are no longer protected by our privacy policy or security practices. You should familiarize yourself with any license or use terms of, and the privacy policy and security practices of, the third-party resource, which will govern your use of that resource.

To the fullest extent permitted by law, BrowserStack shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such third-party resource. BrowserStack disclaims any liability for the content or accuracy, completeness, or reliability of such Data of any third-party resource or for any loss or damage of any sort resulting from the use of, or for any failure of, Data provided at or from a third-party resource on Bug Capture.

Data Privacy
You acknowledge and consent to your Personal Information being stored in the European Economic Area (EEA). BrowserStack may engage with sub-processors in the framework of the provision of the services that may entail a transfer of personal data outside the European Economic Area (EEA). For transfer of Personal Information outside the EEA in relation to each sub-processor, see “Additional Sub Processors for use of Bug Capture Services” below. BrowserStack shall not transfer Personal Information outside the EEA to any country or recipient which is not considered to provide an adequate level of protection according to European Data Protection Laws, unless the parties adopt necessary and adequate safeguards, including, without limitation, the adoption of appropriate standard contractual clauses approved by the European Commission or other legally transfer mechanism, to ensure that the transfer is in compliance with applicable Data Protection Laws.

Data Retention
Data will be retained till such time you withdraw your consent and/or if such Data is no longer necessary for the purpose of the Services.

Definition

Data: Data refers to Customer Content for the purpose of this policy.

Customer Content: For the purpose of this policy, the Customer Content also includes artifacts such as test related logs, test name, test details and metadata information which are required for this service to operate.

Consent
By choosing to access and use the Bug Capture Tool, you are deemed to have consented to these Additional Terms including the Privacy Policy. These Additional Terms are incorporated by reference into the Terms of Service or any other agreement between you and BrowserStack. In case of a conflict between these Additional Terms and the terms mentioned in the Terms of Service, agreement, and/or Privacy Policy pages, these Additional Terms shall prevail.
